Whereas Springwater Council believes in equality and in the fair and equitable treatment for all; and, Whereas most members of Council participate in the Ontario Municipal Employees' Retirement System ( OMERS ) through Springwater Township; and, Whereas Council recognizes that the majority of members derive certain financial benefits from their participation in the OMERS plan; and, Whereas it has come to light that participation in OMERS is not inclusive to all members of Council and that unconscious bias has resulted in age discrimination of some members being excluded from OMERS participation, and therefore disadvantaged to the financial benefit provided to other members of Council who participate in the plan; and, Whereas the Human Rights Code, 1990, states the following: Compensation 25(4) An employer shall pay to an employee who is excluded because of a disability from an employee benefit, pension or superannuation plan or fund or a contract of group insurance between an insurer and the employer compensation equivalent to the contribution that the employer would make thereto on behalf of an employee who does not have a disability. R.S.O. 1990, c. H.19, s. 25 (4); 2001, c. 32, s. 27 (5). Be It Resolved That Council now seeks to remedy this disadvantage, consistent with the Ontario Human Rights Code , and correct the oversight through reformative action bringing equality, equity, fairness, and complete inclusiveness; and, Further That staff be directed to calculate the OME
