Committee of Adjustment

That this Committee of Adjustment meeting held on February 28, 2024 come to order at 6:00 pm.

That the Committee of Adjustment minutes dated January 24, 2024 be adopted as presented.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 45 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the land in question and its surroundings as addressed in the Planning Report on the application dated February 28, 2024, the correspondence received and information presented at the hearing held on February 28, 2024 and the discussion on the matter, hereby APPROVE application A03/24.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 45 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the land in question and its surroundings as addressed in the Planning Report on the application dated February 28, 2024, the correspondence received and information presented at the hearing held on February 28, 2024 and the discussion on the matter, hereby APPROVE application A04/24.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 53 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the land in question and its surroundings as addressed in the Planning Report on the application dated January 24, 2024, the correspondence received and information presented at the hearings held on January 24, 2024 and February 28, 2024, and the discussion on the matter, hereby APPROVE of the application as applied for subject to the following conditions: That the applicant meet all the requirements, financial or otherwise of the Municipality; That the applicant provide two (2) copies of the registered survey of the conveyed lands, prepared by an Ontario Land Surveyor; That the owner/applicant satisfy and be responsible for all costs to satisfy Section 65 of the Drainage Act, 1990, if applicable; and, That the conveyed lands and benefitting lands be merged on title.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 53 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the land in question and its surroundings as addressed in the Planning Report on the application dated February 28, 2024, the correspondence received and information presented at the hearings held on February 28, 2024 and the discussion on the matter, hereby APPROVE of the application as applied for subject to the following conditions: That the applicant satisfy all of the requirements, financial or otherwise of the Municipality; That the applicant provide two (2) copies of the registered survey of the severed lands, prepared by an Ontario Land Surveyor; That the owner/applicant satisfy and be responsible for all costs to satisfy Section 65 of the Drainage Act, 1990 if applicable; That the applicant pays any required parkland dedication fee(s) in accordance with the Township policy, if applicable; That the applicant provide confirmation, to the satisfaction of the Chief Building Official, that the septic and well are wholly contained within the severed lot; and, That the applicant obtain an entrance permit for the retained farmlands.

That this Committee of Adjustment meeting held on February 28, 2024 does now adjourn at 6:35 pm. The Committee of Adjustment will meet next on Tuesday, March 26, 2024 at 6:00 pm.
