Committee of Adjustment

That this Committee of Adjustment meeting held on October 26, 2022 come to order at 7:02 pm.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 45 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the land in question and its surroundings as addressed in the Planning Report on the application dated October 26, 2022, the correspondence received and information presented at the hearing held on October 26, 2022 and the discussion on the matter, hereby APPROVE Application A36/22 as applied for.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 45 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the land in question and its surroundings as addressed in the Planning Report on the application dated October 26, 2022, the correspondence received and information presented at the hearing held on October 26, 2022 and the discussion on the matter, hereby APPROVE Application A37/22 as applied for. That the Committee of Adjustment, having given consideration to the applicable provisions of Section 45 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the land in question and its surroundings as addressed in the Planning Report on the application dated Committee of Adjustment October 26, 2022 Page 4 of 9 October 26, 2022, the correspondence received and information presented at the hearing held on October 26, 2022 and the discussion on the matter, hereby APPROVE Application A38/22 as applied for.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 53 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the subject land and its Committee of Adjustment October 26, 2022 Page 5 of 9 surroundings as addressed in the Planning Report on the subject application dated October 26, 2022, the correspondence received, and information presented at the hearing held on October 26, 2022, and the discussion on the matter, hereby APPROVE of the application B13/22 as applied for subject to the following conditions: 1. That the applicant meet all the requirements, financial or otherwise of the Municipality; 2. That the applicant provide two (2) copies of the registered survey of the severed lot prepared by an Ontario Land Surveyor; 3. That the owner/applicant satisfy and be responsible for all costs to satisfy Section 65 of the Drainage Act, 1990, if applicable; 4. That the applicant obtain an entrance permit for the retained lands to the satisfaction of the Township, if applicable; 5. That the applicant rezone the retained lands to an Agricultural Consolidation (AC) Zone to prohibit residential uses and that any keeping of livestock in the existing agricultural buildings be subject to MDS requirements; 6. That the applicant provide an undertaking and draft transfer demonstrating that the retained farmlands will be transferred to a ‘bona fide’ farmer; 7. That it be confirmed that the private well and

That the applicant meet all the requirements, financial or otherwise of the Municipality; 2. That the applicant provide two (2) copies of the registered survey of the severed lot prepared by an Ontario Land Surveyor; 3. That the owner/applicant satisfy and be responsible for all costs to satisfy the requirements of Section 65 of the Ontario Drainage Act, R.S.O. 1990, c. D. 17, if applicable; 4. That the applicant rezone the severed lands to ‘Agricultural Exception (A-54) Zone’ to recognize the size of the accessory buildings and prohibit the keeping of livestock within them; 5. That the applicant rezone the retained farmlands to an Agricultural Consolidation (AC) Zone to prohibit residential uses; 6.
