Committee of Adjustment

That this Committee of Adjustment meeting held on August 24, 2022 come to order at 7:03 pm.

That Member Rick Webster be appointed to the position of Chair for the August 24, 2022 meeting of the Committee of Adjustment.

That the Committee of Adjustment minutes dated July 27, 2022 be adopted as presented.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 45 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the land in question and its surroundings as addressed in the Planning Report on the application dated August 24, 2022, the correspondence received and information presented at the hearing held on August 24, 2022 and the discussion on the matter, hereby APPROVE Application A32/22 as applied for.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 45 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the land in question and its surroundings as addressed in the Planning Report on the application dated August 24, 2022, the correspondence received and information presented at the hearing held on August 24, 2022 and the discussion on the matter, hereby APPROVE Application A33/22 as applied for.

That the Committee of Adjustment, having given consideration to the applicable provisions of Section 53 of the Planning Act, the Official Plan of the Township of Springwater, the characteristics of the subject land and its surroundings as addressed in the Planning Report on the subject application dated August 24, 2022, the correspondence received, and information presented at the hearing held on August 24, 2022, and the discussion on the matter, hereby APPROVE of the application B12/22 as applied for subject to the following conditions: That the applicant satisfy all of the requirements, financial or otherwise of the Municipality; That the applicant provide two (2) copies of the registered survey of the severed lands, prepared by an Ontario Land Surveyor; That the owner/applicant satisfy and be responsible for all costs to satisfy Section 65 of the Drainage Act, 1990 if applicable; That the conveyed lands be merged with the benefitting lands, known municipally as 2422 Flos Road 6 West; and, The applicant rezone the conveyed lands to Agricultural Exception (A-46), consistent with the benefiting lands.

That the Committee of Adjustment receive the correspondence as attached as Item 5.1 to the Agenda, being an Acknowledgement Letter from the Ontario Land Tribunal regarding the appeal for Minor Variance Applications A04/22 – A10/22.

That this Committee of Adjustment meeting held on August 24, 2022 does now adjourn at 7:37 pm.
